Welcome to DietLog. These Terms of Use ("Terms") govern your access to and use of the DietLog website (dietlog.today), mobile applications, and services. By creating an account or using DietLog, you agree to be bound by these Terms.

1. Critical Medical Disclaimer

DietLog is NOT a medical device, service, or healthcare provider. The platform, including food tracking, metrics, and AI Coach responses, is designed for general informational, fitness, and wellness purposes only.

• No Medical Advice: DietLog does not provide medical advice, diagnosis, treatment, or prescribe diets.
• Consult a Doctor: Always consult a qualified healthcare professional or dietitian before starting any new diet, fitness program, or if you have any pre-existing medical conditions (e.g., diabetes, eating disorders, pregnancy).
• Accuracy Not Guaranteed: Calorie counts, macronutrients, and AI suggestions are estimates and should not be relied upon for critical medical decisions.

By using DietLog, you acknowledge and accept that you are solely responsible for your health decisions.

2. Eligibility and Account Setup

You must be at least 13 years of age (or the minimum age of digital consent in your country) to use DietLog. If you are under 18, you must have the consent of a parent or legal guardian. You agree to provide accurate registration information and keep your account credentials secure. You are responsible for all activities under your account.

3. Acceptable Use Policy

You agree to use DietLog strictly for personal health tracking. You shall not:

• Use the service for any unlawful, harmful, or fraudulent purpose.
• Attempt to hack, reverse-engineer, decompile, or disrupt DietLog's servers or mobile application.
• Use automated scripts, bots, or scrapers to extract data or bypass AI message limits.
• Upload malicious code, viruses, or offensive content.
• Use the app to track data of another individual without their explicit consent.

4. Subscriptions and Billing

DietLog offers a Free tier and a premium Pro subscription.

• Web Billing: Subscriptions purchased via our website are processed securely by Razorpay. These auto-renew based on the selected cycle (monthly/yearly) unless cancelled.
• Google Play Billing (Mobile App): Subscriptions purchased through the Android app are managed entirely by Google Play. You can manage, cancel, or request refunds for these subscriptions via your Google Play Account settings.
• Cancellations: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing cycle. Access to Pro features remains active until the cycle ends.
• Refunds: Web subscriptions are generally non-refundable except under our 7-day policy for annual plans. App subscriptions fall under Google Play's refund policies.

5. Intellectual Property Rights

DietLog retains all ownership rights, copyright, and intellectual property over the app's software, design, logos, and features. You may not distribute, modify, or create derivative works of our software.

You retain full ownership of all personal health data you input into the app. You grant us a restricted license to store and process this data solely to provide you with the DietLog service.

6. Third-Party Services and AI

DietLog integrates with third-party providers (e.g., Google Cloud, AI models, food databases). We do not guarantee the uptime or absolute accuracy of these external services. The AI Coach utilizes external large language models; while we implement strict safety prompts, you acknowledge that AI responses may occasionally be inaccurate or inappropriate.

7. Limitation of Liability

To the fullest extent permitted by applicable law, DietLog and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to health complications, personal injury, or data loss, resulting from your use of or inability to use the service. Your use of DietLog is entirely at your own risk.

8. Indemnification

You agree to indemnify and hold harmless DietLog, its developers, and affiliates from any claims, damages, liabilities, and expenses arising from your violation of these Terms or misuse of the app.

9. Account Termination

We reserve the right to suspend or terminate your account immediately, without prior notice, if you breach these Terms (e.g., abusing the AI limits, exploiting bugs). You may terminate these terms at any time by deleting your account via the app settings or by contacting us.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
